Legal Salvia

Is there Legal Salvia available? A question many often ask. A simple answer to this is that Yes Salvia is Legal, atleast in the United States, there is no a proper control on salvia. What does it mean?  That all parts of the plant and its extracts are legal to cultivate, buy, sell and possess. If it is acquired as a supplement, this purchase must conform to U.S. supplement laws. If it is sold for consumption as a food or drug, sales are brought under the control of law by the FDA. It’s been learned that the federal analog act demands that in order to qualify as an analog, a substance must be chemically identical to a substance which is federally stated. In the case of salvia divinorum, is chemically rather different from other programmed substances and as a plant completely unlikely to be affected by this act. Although, selling salvia divinorum for human consumption as a drug is possibly not legal in the U.S. under the Food, Drug & Cosmetics Act and consequently it sale as a drug would be controlled by the FDA. Nevertheless, the DEA’s analysis is fully blemish. The Federal Analogue Act, as actually understood, requires that a substance be chemically identical might satisfy the paragraph II of such Act test, but it’s also just incorrect. It’s been proved salvinorin is not a similar chemical of any stated substance. Under the rigid California Analog Act, salvia could possibly be prosecuted if it is sold for human consumption as a psychoactive substance.

In Australia, recommendations for Legal salvia divinorum took effect in 2002 stating that makind dried or prepared salvia, illegal to buy, sell or possess. Although, it is unclear if live salvia divinorum plants are now illegal as well. Previously, there were only three plants that were not legal in this country: The opium poppy, cannabis and erythroxylum species that contain cocaine. Also, there are different plants that are comprised of scheduled substances and are not usually considered illegal as long as the participating chemicals are not educed from them and they are not prepared for consumption. This is probably now the case with salvia divinorum as well. Australia is the first country to have passed laws against possession of Salvia divinorum. In Belgium salvinorin A was included into the list of controlled psychotropic substances in 2004. In Denmark, salvia divinorum and salvinorin were included in the list of restrained substances in 2003. In Finland, laws were passed against the import of salvia divinorum in 2002. In Germany, salvia divinorum is not restricted. It seems that in Israel, salvia divinorum did not cause the big fuzz as in any other countries. It hasn’t have a high demand. Although the chief pharmacist at the Ministry of Health has stated that it is not illegal to possess, it might be illegal to sell, due to the fact it is not an approved drug.
